TERMS AND CONDITIONS FOR ACCOMMODATION CCONTRACTS
Article 1. [Scope of Application]
The terms herein shall govern the Hotel Accommodation Contract and related contracts. Clauses not specified herein shall follow relevant laws and ordinances or customs, as the case may be.
2. Notwithstanding the above Clause, the Hotel may accommodate Special
Contracts that do not violate the terms of this Contract and relevant laws,
ordinances, and customs.@
Article 2. [Submission of a Hotel Accommodation Contract]
A guest who wishes to conclude Hotel Accommodation Contract shall provide
the following information:
@@(1) name of the guest;
@@(2) accommodation dates and scheduled arrival time;
@@(3) method of payment of the accommodation charges indicated.
@@(4) other information required by the Hotel.
2. If a guest requests an estension of their current stay beyond the
date indicated in item (2) above. the Hotel shall consider such a request
as a new Hotel Accommodation Contract.@
Article 3. [Conclusion of a Hotel Accommodation Contract]
A Hotel Accommodation Contract becomes valid when the Hotel accepts the guest's
submitted application containing the information indicated in the
above Article 2, unless the Hotel CAN prove that it had rejected
such application.
2. When a Hotel Accommodation Contract is concluded as specified in
the above Clause, the guest shall submit, by the deadline specified by the
Hotel, no more than the basic accommodation charge for the accommodation
period as the advance payment.@
3. The advance payment shall be applied to the quest's final total
accommodation charges. If a situation arises that falls under the terms of
both Article 6 and Article 17, this advance payment shall be appropriated
to cover the cancellation fee plus any damages. If any balance remains from
the advance payment, the Hotel shall return the balance when the final accommodation
payment is transacted as specified under Article 12.
4. If the Hotel does not receive the advance payment by the specified
date according to Clause 2 above, the Hotel Accommodation Contract shall be
terminated. However, this applies only if the Hotel has appropriately notified
the guest of the deadline for the advance payment.
Article 4. [Special Contracts Not Requiring Advance Payment]
Notwithstanding Clause 2 of Article 3, the Hotel may accommodate Special
Contracts not requiring advance payment upon conclusion of the contract.
2. Upon submission of the guest's application for a Hotel Accommodation
Contract shall be a Special Contract as defined in the preceding clause if
the Hotel does not request advance payment as indicated in Clause 2 of Article
3 or does not designate a deadline for the advance payment.
Article 5. [Right of Refusal to Conclude a Hotel Accommodation Contract]
The Hotel may refuse to conclude a Hotel Accommodation Contract in the following cases.
@@(1) An application for accommodation is submitted outside the terms of this contract.
@@(2) No vacant accommodations are available.
@@(3) The prospective guest is recognized as being at risk of behaving in a manner contrary to the
provisions of laws and ordinance, public order and good morals regarding use
of the accommodations.
@@(4) The prospective guest is assessed as having an apparent contagious disease.
@@(5) The guest submits a request that exceeds the rational scope of the accommodations.
@@(6) Providing accommodation is rendered impossible by an act of God, malfunction within the facility, or other unavoidable reason.
@@(7) The guest's circumstances fall under Oldnance 10 of the Osaka Prefectural Hotel Business Law, as follows.
@@a) the prospective guest is assessed as being inebriated, as posing a risk to the other guests; or
@@b) the guest's garments or personal effects are assessed as being very unhygienic and at risk of endangering the hygiene of other guests.
2. The guest does not follow the Hotel's posted usage regulations.
Article 6. [Right of the Guest to Withdraw from the Hotel Accommodation Contract]
The guest may cancel the accommodation contract by notifying the Hotel.
2. If the guest cancels all or part of the accommodation contract for
reasons attributable to the guest, the Hotel is entitles to request the relevant
cancellation fee (except for cases in which the Hotel has specified a deadline
for advance payment according to Clause 2 of Article 3, but the guest has
cancelled the Hotel Accommodation Contract before making such payment). Moreover,
a cancellation fee shall apply in cases where the Hotel has engaged in a Special
Contract according to Clause 1 of Article 4 and has notified the guest of
the obligation to pay such a cancellation fee at the time of acceptance of
the Special Contract.
3.@Unless the guest has given notice of delay, the Hotel may cancel the Hotel Accommodation Contract when it deems the guest has cancelled in the case of a no-show by 10:00 p.m. (or by two hours beyond the scheduled arrival time) on the agreed day of arrival.
Article 7. [Right of the Hotel to Withdraw from the Hotel Accommodation Contract]
The Hotel may cancel the accommodation contract in the following cases.
(1) The guest is determined to be at risk of behaving in a manner contrary to the provisions of laws and ordinances, public order and good morals regarding the use of the accommodations.
(2) The guest is assessed as having a contagious disease.
(3) The Hotel is unable to give accommodations due to natural disaster or other unavoidable circumstance.
(4) The guest poses a risk of disturbing other guests due to drunkenness or other cause, such as speech or conduct.
(5) The guest is an indicated organized-crime group (hereafter, gorganized-crime grouph) or an indicated member of an organized-crime group (hereafter, gmember of an organized-crime grouph) as determined by the gLaw for the Prevention of Wrongful Acts by Organized Crime Groupsh (effective March 1, 1992), or related individuals and other antisocial forces.
(6) The guest is an organization or other group whose business activities are dominated by an organized-crime group or member thereof.
(7) An organization whose directorship includes a person that is a member of an organized-crime group.
(8) The guest disturbs other guests through speech or conduct.
(9) The guest is assessed as having used force, intimidation, threats or making other coercive unfair demands of the accommodation facilities or accommodation facilities staff (employees), has made requests that exceed the rational scope of accommodations, or other has performed some other similar act.
(10) The guest fails to follow regulations determined by the hotel.
(11) The guest smokes in bed, abuses fire protection equipment or otherwise fails to follow the regulations determined by the hotel (as required to prevent fires).
2. If the Hotel cancels the accommodation reservation under the stated articles of the regulations, the Hotel shall not charge for the unused reserved room. If the guest has made an advance payment, it shall be returned. However, the Hotel retains the right to charge a cancellation fee as specified in Table 2 (attached).
Article 8. [Registering for Accommodation]
The guest shall register by providing the following information at the front
desk of the Hotel upon his ro her arrival:
@@(1) name, age, gender, address, nationality, and occupation of the guest;
@@(2) for foreign nationals: nationality, passport number, and port of entry and date of entry into Japan;
@@(3) scheduled departure date and time.
@@(4) other information as deemed neccessary by the Hotel.
2.@If the guest wishes to pay the accommodation charges with lodging coupons or other substitute for domestic currency as indicated in Article 12 the guest shall submit the substitute payment for approval during registration at the front desk.
Article 9. [Start and End of Accommodation Period]
The guest is required to vacate the room by the checkout time of 10:00 a.m.
2.@The Hotel may allow use or the room beyond the stated checkout time. In this case, the following additional charges shall apply.
@@(1)Up to three hours past the checkout time: 30% of the daily room rate
@@(2)Up to six hours past the checkout time: 50% of the daily room rate
@@(3)Beyond six hours past the checkout time: 100% of the daily room rate
Article 10. [Observance of Hotel Regulations]
The guest shall adhere to the hotel regulations posted in the Hotel.
Article 11. [Business Hours]
The standard hours for the hotel front desk are indicated below. Hours for other facilities are indicated in the hotel pamphlet and are posted in various lovcations in the Hotel and in the guest rooms.

2.@The Hotel reserves the right to temorarily change the hours indicated in the preceding Clause should an unavoidable situation arise. In such a case, the Hotel shall make every effort to inform the public an appropriate manner.
Article 12. [Payment of Charges]
Payment of the accommodation charges shall be made at the front desk or automatic payment machine with domestic currency, or alternatively credit card or accommodation coupons confirmed by the Hotel as acceptable upon check-in or when so requested by the Hotel.
2. The guest shall be responsible for the full accommodation charge even if the guest chooses arbitrarily not to use the room after the Hotel has provided the room and its services to the guest.
Article 13. [Tesponsibillities of the Hotel]
The Hotel's responsibility to provide accommodations begins when the guest
registers at check-in for the accommodations at the hotel front desk, ro
when the guest enters the reserved room. whichever is earliest, and
terminates when the guest vacates the orderd room upon checkout.
2.@If the guest suffers damages through the Hotel's performance or
failure to perform the terms of the Hotel Accommodation Contract, the Hotel
shall provide the guest with compensation for damages. However, the Hotel
shall not be responsible if the damages are not attributable to the Hotel.
Article 14. [Safekeeping of Deposited Goods]
The Hotel shall be liable for any goods. currency, and valuables the
guest places in the custody of the front desk, The Hotel shall
compensate the guest for any damage to such items, such as loss
or damage, except when such damage is caused by an act of God,
However, in cases where the Hotel requests disclosure of the
category and value of any such lost or damaged currency and
valuables and the guest fails to disclose such information, the
Hotel's liability shall be limited to a maximum of 100,000.
2.@The Hotel is in no way responsible for any goods, currency, or valuables
that the guest brings into the Hotel and does not place in
the safekeeping of the front desk. However, if any such loss and damage is
caused by the Hotelfs intentional or inadvertent
negligence, the Hotel shall be liable for providing compensation for
such damage.
Article 15. ySafekeeping of The Guest's Baggage and Personal Effectsz
Should the guest's baggage arrive at the Hotel prior to the guest's check-in,
the Hotel shall safeguard this baggage and hand it to the guest at the front
desk at check-in only if the Hotel has consented to do so before the arrival
of the baggage.
2. If the guest should leave his or her baggage or personal effects
behind at the Hotel after checking out and the owner of the baggage can be
identified, the Hotel shall make an effort to contact the guest and request
instructions. However, if its owner does not provide instructions, or the
owner of the baggage ccannot be identified, the Hotel shall safeguard the
baggage for a maximum of seven days (including the day the baggage is found),
and shall thereafter files notice with the local police.
3. In the case of Clauses 1 and 2 above, the Hotel's scope of responsibility
to safeguard the guests baggage or personal effects shall be limited to that
specified in Clause 1, Article 14, and Clause 2, Article 1 4, respectively.
Article 16.y Liability in regard to Parkingz
The Hotel shall not be liable for the custody of the vehicle of the
Gest when the Guest utlizes the parking lat within the premises of the
Hotel, as it shall be regarded that the Hotel simply offers the space
for parking, whether the keyh of the vehicle has been deposited with
the Hotel or not, However, the Hotel shall compensate the Guest for the damage caused through intention or negligence
on the part of the Hotel in regard to the management of the parking lot.
Article 17. [Responsibilities of the Guest]
The guest is responsible for paying reparations to the Hotel in the event the Hotel suffers damages whether caused by the guest intentionally or through negligence.
Article 18. [Exemption Clause]
The guest takes full responsibility for his or her own use of computer transmissions within the Hotel. The Hotel bears no responsibility in the event that the user suffers any damages for any reason including, but not limited to, service failure due system damage or any other reason during computer transmission. Furthermore if the computer transmission usage is deemed as an inappropriate action and the Hotel or a third party suffers damages, the guest will make all reparations.
Article 19.[Bathing tax]
The hotel collects a bathing tax (Takayama municipal tax) of
>\150 per adult (over 12 years of age). This bathing tax cannot be refunded
>after checking out under any conditions.
Article20. [Governing Law and Jurisdiction]
The court that has jurisdiction over the location of the Hotel shall decide any dispute related to these provisions in accordance with the laws and ordinances of Japan.

- The listed percentage is the percentage of the basic accommodation fee paid as a cancelation fee.
- If the number of days is reduced, a charge of one day (the first day) cancellation fee will be applied regardless of the number of days reduced.
- If a portion of a group of customers (15 or more) cancels ten days before staying (or if applying after that date, cancelling on the date applied), and if the number of those cancelling is 10% or less (rounded up) of the total members, no cancellation fee shall apply.
